Our team uses a multidisciplinary approach including former Assistant United States Attorneys and litigators with experience representing financial institutions, brokerage firms, online trading brokers, individual traders, and cryptocurrency exchanges worldwide. RSHC’s B&C team includes those with extensive experience in the field of white collar defense, investigations, and compliance. RSHC white collar defense lawyers have tried more than 200 cases, over half of which were criminal cases, before state and federal juries. And we have conducted even more investigations – as outside counsel, in-house counsel, and government attorneys – throughout the country and in Europe, Africa, Asia, and Latin America. We have represented both firms and individuals in investigations by regulators with jurisdiction over B&C-related products, including the DOJ, state attorneys general, the SEC, the CFTC, and various financial exchanges. RSHC lawyers have also represented multiple officers and directors of publicly traded companies in securities class actions and shareholder derivative litigation involving claims of breach of fiduciary duty, waste of corporate assets, insider trading, and other alleged wrongdoing. We have also defended a global financial institution in multi-billion-dollar mortgage-backed security litigation.
Our Approach and Results
Educate. RSHC’S B&C team first seeks to educate the audience, whether it is the judge, the government, or civil litigants, regarding the technology at issue. Oftentimes, common banking and financial expectations do not fit with the ever evolving technological advances in this space. The ability to provide courts and opponents with a nuanced understanding of the differences – and similarities – between cryptocurrency and fiat currency helps us vindicate our clients’ rights in a variety of disputes.
Our lawyers have participated in the following matters:
- Won dismissal of multiple lawsuits against former pioneering founder of cryptocurrency exchange alleging fraud, conversion, and breach of contract.
- Defended cryptocurrency exchange executive in claims brought by the New York Attorney General resulting in a favorable resolution.
- Represented Chief Compliance Officer in investigation by the Commodity Futures Trading Commission, Securities and Exchange Commission, and Department of Justice related to stablecoin offerings.
